1. Agreement to Terms

By accessing or using media.thepom.app ("the Service," "we," "us," or "our"), operated by Intelligent Iterations ("the Company"), you ("you," "your," or "User") agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not access or use the Service.

If you are using the Service on behalf of a business or entity, you represent that you have the authority to bind that entity to these Terms, and "you" refers to both you individually and the entity.

2. Description of Service

media.thepom.app is a web-based content creation and publishing platform that enables users to:

The Service acts as an intermediary between you and third-party platforms, including TikTok and OpenAI. Your use of those platforms is additionally governed by their respective terms and policies.

3. Eligibility

You must be at least 18 years of age to use the Service. By using the Service, you represent and warrant that you meet this age requirement. If you are under 18, you may not create an account or use the Service.

4. Account Registration

To access certain features, you must authenticate via TikTok OAuth. By doing so, you authorize us to access your TikTok account information as permitted by the scopes you approve (including basic user information and the ability to publish content on your behalf). You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account.

5. User Content and Ownership

5.1 Your Content

You retain full ownership of all content you upload, create, or publish through the Service ("User Content"). By using the Service, you grant us a limited, non-exclusive, temporary license to store, process, and transmit your User Content solely for the purpose of providing the Service — specifically, to facilitate the upload and publication of your content to TikTok.

5.2 Content Responsibility

You are solely responsible for all User Content you upload, publish, or otherwise make available through the Service. You represent and warrant that:

5.3 Prohibited Content

You agree not to use the Service to upload, store, or publish content that:

6. Temporary Media Storage

6.1 Firebase Storage

To facilitate photo carousel uploads to TikTok, User Content (specifically, images) is temporarily stored on our servers via Google Firebase Storage. This is a technical requirement of TikTok's Content Posting API, which requires content to be accessible via a URL during the upload process.

6.2 Retention and Deletion

6.3 No Guarantee of Storage

The Service is not a file storage or backup service. We do not guarantee the availability, integrity, or recoverability of any User Content stored on our servers. You are solely responsible for maintaining your own copies of all content.

7. Third-Party API Keys

7.1 OpenAI API Key

The Service allows you to provide your own OpenAI API key for AI-powered content suggestion features. By providing your API key:

7.2 Security of API Keys

While we implement reasonable security measures, we cannot guarantee absolute security. You provide your API key at your own risk. We strongly recommend using API keys with usage limits and regularly monitoring your OpenAI account for unauthorized activity.

8. Website Scraping for Content Ideas

8.1 Your Authorization

When you provide a website URL for content idea generation, you represent and warrant that:

8.2 Limitations

We scrape only publicly accessible content from the URLs you provide. We do not access password-protected areas, circumvent technical barriers, or collect personal information from third-party websites. Scraped content is used solely for generating content suggestions during your session and is not permanently stored.

9. TikTok Integration

9.1 TikTok's Terms

Your use of the TikTok publishing features is subject to TikTok's Terms of Service, Community Guidelines, and Music Usage Confirmation. By posting content through the Service, you agree to comply with all applicable TikTok policies.

9.2 Content Posting

When you publish content to TikTok through the Service:

9.3 Commercial Content Disclosure

If you post commercial content through the Service, you are responsible for properly disclosing it in accordance with TikTok's Branded Content Policy and all applicable advertising disclosure laws.

10. Acceptable Use

You agree not to:

11. Intellectual Property

11.1 Our Property

The Service, including its design, features, code, documentation, and branding, is owned by the Company and is protected by copyright, trademark, and other intellectual property laws. Nothing in these Terms grants you any right, title, or interest in the Service except as expressly stated.

11.2 Feedback

If you provide us with feedback, suggestions, or ideas regarding the Service, you grant us an unrestricted, perpetual, irrevocable, royalty-free license to use such feedback for any purpose without obligation to you.

12. Disclaimers

12.1 "As Is" Basis

TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

12.2 No Guarantee of Availability

We do not guarantee that the Service will be available, uninterrupted, secure, or error-free. We may modify, suspend, or discontinue the Service (or any part thereof) at any time without notice.

12.3 Third-Party Services

We are not responsible for the availability, accuracy, or reliability of third-party services integrated with the Service, including TikTok, OpenAI, and Google Firebase. You agree to indemnify, defend, and hold harmless the Company and its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from:

15. Termination

15.1 By You

You may stop using the Service at any time.

15.2 By Us

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Reasons for termination may include, but are not limited to, violation of these Terms, suspected fraudulent activity, or extended periods of inactivity.

15.3 Effect of Termination

Upon termination, your right to use the Service ceases immediately. Any media pending upload will be deleted. Sections that by their nature should survive termination (including Sections 5, 12, 13, 14, and 17) shall survive.

16. Changes to Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by posting the updated Terms on the Service and updating the "Last Updated" date. Your continued use of the Service after the effective date of any changes constitutes your acceptance of the revised Terms.

17. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles. Any dispute arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts located in the Province of Ontario, Canada.

18. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
